Rapper and entertainer, Cardi B, her sister, Hennessy Carolina, and her sister’s girlfriend, Michelle Diaz are all being sued by beachgoers after an altercation that happened Labor Day weekend in New York on September 6, 2020.
According to a lawsuit filed in Suffolk County on September 21 and obtained by Billboard, plaintiffs Peter Caliendo, Pauline Caliendo and Manuel Alarconsay that they were at a beach near Smith Point on September 6 when the defendants parked and blocked Alarcon’s vehicle. When Alarcon who wearing a MAGA (Make America Great Again) hat approached driver Diaz, Carolina started filming the interaction and allegedly “shouting foul and threatening language and defamatory statements.”
Billboard explains that they are accusing Carolina of assault and battery, and all three women of defamation of character and violating civil rights to privacy. According to the lawsuit, the plaintiffs are suffering from “fear, intimidation, and mental anguish,” and the loss of fair market value of the use of each plaintiffs’ depictions.” They are seeking attorney’s fees, punitive damages, exemplary damages, costs and disbursements.
When the incident happened on September 6, Cardi B tweeted the video as well as an audio of Hennessy explaining what happened the day at the beach. Cardi backed up Hennessy’s statement that Hennessy and her girlfriend, Diaz, were targeted and harassed by the (in their words) racist MAGA supporters about where they parked their car because they are an Afro/Hispanic gay couple that were speaking Spanish. Ultimately up to the court to decide, the video, originally posted by Carolina, 24, shows the group in a heated argument and slinging insults back-and-forth at each other while near a car on the beach.“I’ll beat the f*** outta you,” Hennessy warned as the group approached her vehicle. She also repeatedly shouted for them to “back the f*** up”. We then see one of the plaintiffs (Pauline Caliendo) stick the middle finger up at Hennessy.They also accused Cardi B, Hennessy Carolina, and Diaz of editing the posted videos “to remove portions thereof, and thereby hold plaintiffs in a false light, so as to tend to expose and in fact expose each plaintiff to public contempt, ridicule and disgrace and harm,” and accusing the plaintiffs of “racism.”
“These peaceful Suffolk County residents were quietly enjoying a Sunday at the Smith Point beach with their families, when rap celebrity Hennessy Carolina suddenly approached them, raging, spitting, insulting, assaulting, defaming and threatening them, all the while videotaping them because one of them wore a MAGA hat,” John Ray, the plaintiffs’ attorney, told ABC New York. “Then Hennessy, Cardi B and celebrity model Michelle Diaz deviously edited the videotape and published the edited version all over social media, across the world for all to see… Real threats of harm were made.
